Terms of Service

These Terms of Service (“Terms”) govern your use of PotooVPN (“we”, “us”, “the Service”) — the mobile and desktop apps, website at potoovpn.com, API, and related features. By creating an account, downloading the app, or using the Service, you agree to these Terms. If you do not agree, do not use PotooVPN.

Who we are / what the Service is

PotooVPN is a polished VPN client built around a carefully curated pool of shared community exits. We operate the client, API, catalog cache, and related product features. We do not operate a private corporate VPN server fleet. Exits are community-run and independently operated; speed, availability, and operator practices can vary.

Eligibility

You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to use the Service. You are responsible for complying with local law where you use PotooVPN.

Accounts

Some features (billing, multi-device sync, support tickets, referrals) require an account. You must provide accurate information and keep credentials secure. You are responsible for activity under your account. We may suspend or terminate accounts that violate these Terms or abuse the Service.

Free use, metering, and Plus

  • Free tier — Real access to the curated pool, subject to fair daily convenience limits (for example connects, session length, and data). Limits exist so free use stays fair; they are not a promise of unlimited service forever.
  • Metering — We enforce quotas using device identifiers and session/usage records as described in our Privacy policy.
  • Plus — A paid product purchase (subscription or lifetime entitlement, as offered) that raises limits and helps fund product stewardship (app, API, curation). Unless we deliberately change the product, Plus users use the same class of curated community exits as free users — not a secret private backbone. Plus is a commercial purchase, not a donation or tax-deductible gift.
  • Web checkout for Plus is processed by Stripe on this site when billing is enabled. Prices and plan details are shown at purchase time on /pricing.

Advertising

The free tier of the mobile app may display advertisements (for example via AdMob or similar partners) when ads are enabled for that build. Plus may reduce or remove ads depending on the plan and platform. Ad partners process data under their own policies; see also our Privacy policy.

Privacy model (best-effort)

Your tunnel is encrypted to the exit you choose. Shared community exits are not a private corporate fleet, so we describe privacy as best-effort — suited to everyday browsing and access — not as an absolute anonymity, untraceability, or threat-model guarantee. Community exits — no uptime or performance warranty

PotooVPN helps you discover, pre-check, and connect to curated exits. We do not operate or control those exits. We do not guarantee that any listed exit will work, remain online, be fast, be safe for every use case, or be lawful in every jurisdiction. Switch exits if one fails. Traffic you send through an exit is subject to that independent operator’s environment.

Acceptable use

You agree not to:

  • Use the Service for illegal activity, abuse, fraud, spam, or attacks on others
  • Attempt to bypass metering, billing, device limits, or security controls
  • Interfere with the Service, catalog, API, or other users’ access
  • Reverse engineer, scrape, or misuse the Service except as allowed by applicable law
  • Misrepresent affiliation with PotooVPN or resell access without our written permission

We may suspend, throttle, or terminate access when we reasonably believe these rules are violated or when needed to protect the Service.

Intellectual property

The PotooVPN client, branding, website, and our original software are owned by us or our licensors. Community exits and third-party software remain the property of their respective owners. These Terms do not transfer ownership of any intellectual property to you.

Third-party services

The Service may rely on third parties (hosting, payment processors such as Stripe, sign-in providers, push/notification platforms, optional analytics/crash tools, ad networks). Their terms and privacy policies apply to their processing. We are not responsible for third-party outages or policies outside our control.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, OR THAT THE SERVICE WILL MEET YOUR SPECIFIC SECURITY OR ANONYMITY REQUIREMENTS.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POTOOVPN AND ITS OPERATORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR FROM COMMUNITY EXIT OPERATORS. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR PLUS IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY US DOLLARS (US$50). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED.

Indemnity

You agree to indemnify and hold harmless PotooVPN and its operators from claims arising out of your misuse of the Service, your violation of these Terms, or your violation of applicable law — except to the extent caused by our willful misconduct.

Changes

We may update these Terms. The “Last updated” date above will change when we do. Continued use after an update means you accept the revised Terms. Material changes to paid plans will be communicated through the Service or email where practical.
